A former Marine took a stab at saving the Christmas spirit yesterday -- knocking over a bloody, knife-wielding Santa that was part of a controversial display outside a Manhattan home. Julius Spohn, 64, of Newark, said he had read about the display in The Post and wanted to see the macabre scene in front of the East 18th Street brownstone belonging to Joel Krupnik and Mildred Castellanos. Er, he might need a refresh on that concept. (Via RA)

It may not be yelling fire in a crowded theatre, but it doesn't offer any real value. If this was a museum or private display, I'd have no problem with it. However, this display is not optional for those who live in the area. People shouldn't be forced to be subjected to what essentially amounts to an insult. Although the marines actions were wrong, I concur that this isn't what he fought for either. If that were the case, Hubris and Dorkafork would probably be on a fast boat to China right now. There are indecency statutes that exist in many states and locales, but obviously this display didn't violate them. Shrug. Once a Marine always a Marine. Secondly, offensive displays do not have rights. People have rights. The First Amendment applies to the government, ie: Congress shall pass no law. . . . . . . Posted by: LargeBill at December 26, 2005 11:11 PM Even if this were a freedom-of-speech issue, I think an argument might be made that a "bloody, knife-wielding Santa" is an "R" rated message, and that displaying it in full view of a public thoroughfare constitutes placing it in a "G" rated environment. Nit-picking aside (e.g. "it's not a movie" and "this is not a business enterprise"), the precedent of restricting freedom of speech in the public interest is clearly established in precedent; the question is whether frightening children and disturbing pedestrians is so indistinguishable from really important speech that it should be allowed to hide behind its skirts to avoid sensible (and irate) correction by private citizens not otherwise completely devoid of common sense. However, as someone else noted, this fellow was not even serving as an agent of the Government in his act of knocking down the display. The rules governing the actions of private citizens are certainly different than those restricting functionaries in their official capacities. Thanks for the info, but let's recap: There are no statutes governing indecency in this case (thus no conflict beyond property rights), the ex-Marine's (Oops, sorry, MARINE'S!) angle on serving his country for certain types of expression was mildly ironic and lightly noted, and no, no one is making a serious comprehensive argument about freedom of speech for this story that requires a lecture appropriate for fourth grade social studies class.
